TENDER NOTICE NO: (  51  )

 

For an on behalf of the Governor of Jammu and Kashmir State, the Executive Engineer, Construction Division, Leh (Explosive Licence No: E/HQ/JK/22/49) invites sealed tenders affixed with Rs.5/- revenue stamps from registered original manufacturer/ authorized distributor (holding explosive stockist licence) for supply of explosive materials on annual contract basis.

The explosive material is to be used for blasting of hard rocks for construction of various roads works in the district LehLadakh.

The material should be of requisite strength as per specification prescribed by Deputy Chief Controller of explosive Nagpur.

The tender accompanied with earnest money 02% of the total value of the contract in the shape of CDR/FDR pledged to District Superintending Engineer, PWD Circle, Leh.

The tender shall be received in the office of the District Superintending Engineer, PWD Circle, Leh upto 2 PM of 9th April 2010, and shall be opened by the contract committee on the same date in presence of the tenderer, who so-ever wish to be present at the time.

Tender without earnest money shall be rejected.

The tender should be accompanied with VAT clearance certificate in form 51 without which tender shasll not be accepted.

The rates quoted by the tenderer must be FOR destination (Stongsar Magazine shed Chuchoot Leh).

The successful tenderer shall have to enter into an agreement deed within 7 days from the date of issue of acceptance of the offer.

The District Superintending Engineer/Contract Committee reserves the right to reject any tender or part of it without assigning any reason thereof.

The successful tenderer shall have to supply the explosive material in their on explosive van duly transit insured upto Magazine shed at Stongsar.

In the even of the successful tenderer failing, declining, neglecting or delaying the supply or in the event of any damage occurring/being caused or in the event of any default or failure by him in complying with any other terms and conditions of the contract the department shall without any prejudice to any other remedy available to it under the law for the time being inforce in the state shall.

a)      Terminate the contract after 15 days notices and or.

b)      Recover the amount of loss caused by damage/failure or default as may be determined by the competent authority of the department and/or.

c)      Recover the extra cost if any involved in allotting the supply to the other party and/or.

d)      Impose a penalty up to 10% of the value of contract as the department may determined on the marits of the case and/or.

e)      Forfeit the earnest money deposit.

 

The explosive material shall be supplied by the lowest tenderer as per the instruction of the Division from time to time and as per the capacity of the Magazine shed.

 

In case of any dispute or any other differences arising at any time between the successful tenderer and the department the same shall be referred to Chief Executive Officer, LAHDC Leh who may give a decision on such dispute and whose decision shall be final and binding open both the parties. In case of arbitration between the successful tenderer and the department, the jurisdiction for contesting the case shall be that of local courts Jammu and Kashmir State only.

 

95% payment with 100% tax and duties shall be paid on delivery of the material at Leh and 5% balance payment shall be released after 6 months or consumption of the explosive material which ever is earlier.

 

Pre dispatch inspection shall be got conducted by the representative of Chief Controller of Explosive Nagpur where ever required, the charges for the same if any shall be reimbursed by the department.

 

All taxes including 1% cess shall be liable to deducted at source at the time of payment.

 

All other terms and conditions as laid down in explosive rule 1883 shall also apply. Any further relevant information/clarification can be had from the district Superintending Engineer, PWD Circle, Leh/ Executive Engineer, Construction Division, Leh
